Official Rules

NO PURCHASE NECESSARY. Open to permanent legal residents of the Contiguous US who are 21 years of age or older as of. the time of entry. Void where prohibited. Odds of winning depend on number of eligible entries received. Sweepstakes begins May 1, 2008, and all entries must be received by 11:59pm Pacific Time (“PT”) on May 23, 2008 (the “Sweepstakes Period”). 1.            SPONSOR: The Sponsor of this Sweepstakes is Bravo Media LLC (“Sponsor””)

2.         HOW TO ENTER. To enter: go to www.bravotv.com and complete the official online entry form which includes your full name, complete address, telephone number and valid e-mail address and submit the entry.  Entries generated by a script, macro or other automated means will be disqualified.  Entries that are incomplete, illegible or corrupted are void and will not be accepted.  Sponsor is not responsible for lost, late, illegible, incomplete, or otherwise misdirected entries or transactions that are processed late or incorrectly or are lost due to computer or electronic malfunction or other error. Sponsor reserves the right to, in its sole discretion, cancel, modify or suspend this sweepstakes should any computer virus, bugs or other technical difficulty or other causes beyond the reasonable control of the Sponsor corrupt the administration, security or proper play of the sweepstakes. All entries become the property of the Sponsor and will not be acknowledged or returned.  ALL ENTRIES MUST BE RECEIVED BY THE SWEEPSTAKES CLOSING DATE: 11:59pm PT on May 23, 2008. If you check the opt in box, you are opting to receive information and promotional materials from Bravo and NBC Universal, Inc. If at any time, you do not wish to receive these materials in the future, please go to Bravo’s privacy policy, located at http:// http://www.bravotv.com/Privacy_Policy/ and follow the procedures indicated.
3.            ELIGIBILITY. Sweepstakes open only to permanent legal residents of the Contiguous United States excluding all residents of Alaska, Hawaii, Puerto Rico, Guam and void where prohibited by law who are 21 years of age at the time of entry. Employees of the Sponsor, NBC Universal, Inc., KAO Brands Company, their respective parents, subsidiaries, affiliate companies and advertising and promotion agencies, and any other entity involved in the development or administration of this Sweepstakes, and members of their immediate families (spouses, parents, children, and siblings and their spouses) are not eligible. Sweepstakes subject to all applicable federal, state, and local laws and regulations.

4.            GRAND PRIZE.  One (1) Grand Prize winner will be awarded a Grand Prize consisting of a trip for the Grand Prize winner and a guest (the “Trip”) to New York, NY to attend Bravo’s A-List Awards show taping, the taping of which is tentatively June 4, 2008.  The Trip includes 1) round trip coach class domestic air transportation for two (2) from a major airport closest to winner’s home (as determined by Sponsor) to one of the major gateway airports nearest New York, NY (as determined by Sponsor); 2) 3 days/2 nights hotel accommodations in a New York metropolitan area hotel (single room, double occupancy), as determined by Sponsor in its sole discretion; 3) A beauty makeover from the John Frieda brand (the “Makeover”), the details of which shall be determined by Sponsor but which is expected to include a hair styling and makeup application, and 4) two (2) tickets to attend Bravo’s A-List Awards show taping.  Sponsor has the right in its sole discretion to substitute ground transportation for air transportation depending on winner’s place of residence.  Approximate Total Retail Value of Trip is $3200.00. Prize value may vary depending upon the actual cost of air transportation from point of departure and return at time of reservation.  The attendance at Bravo’s A-List Awards show by the Grand Prize winner and/or their guest has no cash value.  The value of each prize represents Sponsor’s good faith determination of the maximum retail value thereof.  For Form 1099 reporting purposes, each winner shall be bound by such good faith determination.  If the tickets to the A-List awards are unavailable for any reason the remaining elements of the Grand Prize shall constitute Sponsor’s full prize obligation to Winner.

The Trip awarded to the Grand Prize winner must be taken within dates provided by the Sponsor or that portion of the prize will be forfeited.  Travel arrangements must be made through Sponsor’s agent, on a carrier of Sponsor’s choice.  Certain travel restrictions and black out dates may apply. Winner is solely responsible for all expenses and costs associated with acceptance and/or use of any prize not specifically stated herein as being awarded, including, without limitation, any and all federal, state and local taxes, travel from winner’s residence to and from airport, ground transportation, travel insurance, security and airport fees, taxes, insurance, gasoline, meals, gratuities, and souvenirs.  All prize details are at the sole discretion of the Sponsor.  If winner cannot accept prize (or any portion thereof) as stated, prize will be forfeited and at Sponsor’s discretion, an alternate winner may be selected.    Sponsor will not replace any lost or stolen tickets, travel vouchers or certificates.  Grand Prize winner and guest must travel on same itinerary, including the same departure date, destination and return date, and must have valid travel documents (e.g., valid government issued photo ID and/or passport) prior to departure, and failure to do so will result in forfeiture of prize. All travel and lodging will be at the risk of winner and guest.  Travel companion must complete a travel guest liability/publicity release prior to the Trip, or this portion of the Grand Prize may be forfeited.  Grand Prize winner’s travel companion must be the age of majority in his or her state of residency or Grand Prize winner must be travel companion’s parent or legal guardian and must complete and return all releases on behalf of minor.  Once travel commences, no unscheduled stopovers are permitted; if an unscheduled stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip.  Sponsor is not liable for any expenses incurred as a consequence of flight cancellation/delay.  Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. 

If the Grand Prize winner’s notification is returned as undeliverable, winner is unable to travel on dates specified by Sponsor, winner is ineligible or winner declines a prize, the prize will be forfeited and an alternate winner may be selected at random from all remaining eligible entries received.  No cash or other substitution, assignment or transfer of prizes permitted, except by Sponsor, who reserves the right to substitute a prize or prize component with another of comparable or greater value.  In the event that any prize component is not available for any reason (including, without limitation, tickets to Bravo’s A-List Awards show), then the remaining elements of the prize shall constitute full satisfaction of Sponsor’s prize obligation to the winner and no additional compensation will be awarded. 

5.            DRAWING. Grand Prize winner will be selected in a random drawing conducted on or about May 27, 2008 from among all eligible entries received during the Sweepstakes Period by employees or representatives of Sponsor, whose decisions as to the administration of the Sweepstakes and the selection of potential winner are final and binding in all respects.  Potential Grand Prize winner selected must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements.  Odds of winning depend upon the total number of eligible entries received.

6.            CLAIMING PRIZE/RELEASES. Sponsor will make two (2) attempts to contact the potential Grand Prize winner at the phone number or email address provided at time of entry.  If Sponsor is unable to reach a potential Grand Prize winner via phone or email within this time frame, he/she may be disqualified and any prize may be forfeited and an alternate may be selected.  Except where prohibited, potential Grand Prize winner must sign and return to Sponsor, within two (2) days of attempted notification, an affidavit of eligibility and liability/publicity release. If a potential winner or their respective travel companion fail to sign and return the affidavits of eligibility and liability/publicity releases within the required time period, prize may be forfeited and an alternate entrant may be selected in his/her place at random from among all eligible entries received.

7.            GENERAL.  Acceptance of any prize constitutes permission to Sponsor to use any winner's name, city, state, likeness, voice, biographical information and statements for purposes of advertising, promotion and publicity in any and all media, now or hereafter known, throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law.  By participating, entrant (i) agrees to release and hold Sponsor, NBC Universal, Inc, KAO Brands Company, their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, any other entity involved in the development or administration of the Sweepstakes, and each of their respective directors, officers, employees and assigns (collectively, the “Released Parties”), harmless against any and all claims and liability of any kind (including, without limitation, personal injury, death, and/or property damage) arising in whole or in part, directly or indirectly, out of participation in the Sweepstakes or the acceptance, receipt, possession, misuse, nonuse or use of any prize (or portion thereof); (ii) waives all rights to claim direct, indirect, punitive, incidental and/or consequential damages, attorney's fees or any damages other than actual out-of-pocket costs incurred to enter; (iii) agrees to be bound by these Official Rules and the decisions of the Sponsor and its representatives, which are final and binding on all matters relating to the Sweepstakes, and (iv) agrees to waive any right to claim any ambiguity or error in these Official Rules or the Sweepstakes itself.

Released Parties are not responsible for incomplete, lost, late, stolen, damaged, illegible, misdirected, garbled, inaccurate, delayed or undelivered entries; for any computer, network, technical, mechanical, printing, typographical, human or other errors or problems of any kind relating to or in connection with the Sweepstakes, including, without limitation, errors or problems of any kind that may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement, delivery or use of any prize or in any Sweepstakes-related materials; or for any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes.  CAUTION: Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law, including criminal prosecution.

Due to the nature of television, the dates and times of Bravo’s A-List Awards show are subject to change.  If Bravo’s A-List Awards show (or any portion thereof) is canceled for any reason or if for any reason this Sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these rules), Sponsor reserves the right to postpone, cancel, or modify the Sweepstakes (or any element thereof, including, without limitation, these rules) in any manner and for any reason without notice, in their sole discretion.  Sponsor also reserves the right in its sole discretion, to cancel, suspend or modify the Sweepstakes, or to disqualify any implicated entrant(s), (and their entries) if any fraud, virus, actions by entrants, technical or other error or problem of any kind, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Sweepstakes, as determined by Sponsor in its sole discretion.  In the event of cancellation, Sponsor reserves the right, in its sole discretion, to pick winner(s) in a random drawing from among all eligible entries received by Sponsor up until the time of such cancellation, termination, modification or suspension, as applicable.

In the event of a dispute as to the identity or eligibility of an entrant or winner based on an e-mail address, the entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person 18 years of age or older who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor (excepting compliance with applicable codes and regulations) or other force major event will not be considered a breach of these Official Rules.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant, Sponsor or any of the Released Parties in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of New York.  If any controversy or claim arising out of or relating to the Sweepstakes, the Official Rules, or the breach of any term hereof, cannot be otherwise resolved, it shall be resolved by binding arbitration conducted in the County of New York, and administered by Judicial Arbitration and Mediation Services (“JAMS”) in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (“the JAMS Rules”).  The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be an experienced arbitrator licensed to practice law in New York.  The decision of the arbitrator shall be binding, final and conclusive and shall not be appealable to any court.

11.            WINNER’S NAME For the name of the winner, send a self-addressed, stamped envelope no later than June 6, 2008 to the Bravo A-List Awards Sweepstakes Winners List c/o Bravo 30 Rockefeller Plaza, New York, NY 10112 room 825e-5.
