The Smokinggun.com and BBC.com report that Evel Knievel, the 68-year-old former “Daredevil,” is suing rapper Kanye West for copyright infringement.
Seems West’s video for his single "Touch The Sky" parodied Knievel’s unsuccessful attempt to jump Snake River Canyon in Idaho in 1974. In the video. West wears a similar costume as Knievel, rides a “skycycle” like Knievel, and is even named “Evel Kanyevel.”
Yep, no mistaking the similarity. (Not to mention cheesiness! Kanyevel? Puh-lease.) However, isn’t “parody” protected by the constitution? Yep. But according to Knievel’s lawyer the West video is no parody.
"A parody is something that's characterized by comedic content and that video is not a comedy," Knievel’s lawyer told Reuters news agency. "It's a music video used to sell Mr. West's musical works."
In other words, the elderly Evel Knievel is turning into Litigious Knievel.
Regardless, we wouldn’t mind if Knievel won the lawsuit. (Although we doubt he will.) The defunct daredevil is going through some major health challenges and probably could use the money. He’s broken around 40 bones during his career and has plates and titanium parts all through his body. Not only that, Knievel had a stroke in 2005 and is suffering from pulmonary fibrosis with only about 2 years to live.
Fer heaven's sake, West should toss the old guy a bone at least. (Which he hopefully won’t break.)
We figure West kind of deserves to pay – not because he broke any law – but because of his infamous hissy fit on the MTV video music awards for losing “Best Video.” Remember that? Turns out it’s the same video! Hah! Karma can be a bee-yatch! (Or should we call that Kanyarma?)
