Top Chef Fan Favorite Official Rules

These Voting Rules and Procedures are subject to change at any time at the sole discretion of Bravo Media LLC (“Bravo”). Void where prohibited.

Each week you can cast your vote online at www.bravotv.com (the “Website”) or by text message to help determine which Top Chef contestant wins the title of Top Chef Fan Favorite (the “Campaign”) and receives a $10,000 prize (the “Prize”). The original fifteen (15) Top Chef contestants casted for Season 15 prior to the Top Chef premiere are eligible to win the Prize. 

Voting (“Voting”) is simple and easy. To vote, tune in to Top Chef on Bravo and follow the on-air instructions. Check your local listings to see when Top Chef airs in your area. Voting will be conducted pursuant to these Voting Rules and Procedures and any such other rules and procedures as Bravo may from time to time designate.

Eligibility: You must be eighteen (18) years of age or older to submit your vote (“Vote”). You must be a permanent legal resident of the fifty (50) United States or the District of Columbia (“Geographic Area”). Votes must be cast by the authorized account holder of the cell phone or Bravo TV sign in from which the Vote is made.

Voting Period and Restrictions: Voting is open from the start time during each weekly voting period, as designated below (each, a “Weekly Voting Period”), and ends at the end time of each Weekly Voting Period, as specified below. After each Weekly Voting Period, the Top Chef contestant with the most Votes will move forward to the next Weekly Voting Period. The Top Chef contestant with the fewest Votes will be eliminated from the Campaign.

Week 1: Start Time: 2/14/19 at 8:00 PM ET, End Time: 2/21/19 at 4:00 PM ET, # of Contestants: 15

Week 2: Start Time: 2/21/19 at 8:00 PM ET, End Time: 2/28/19 at 4:00 PM ET, # of Contestants: 8

Week 3: Start Time: 2/28/19 at 8:00 PM ET, End Time: 3/7/19 at 4:00 PM ET, # of Contestants: 4

Week 4: Start Time: 3/7/19 at 8:00 PM ET, End Time: 3/14/19 at 4:00 PM ET, # of Contestants: 2

Voting is currently limited to forty (40) Votes per person per Weekly Voting Period, regardless of method, but Bravo reserves the right to change the limit on the number of Votes, in its sole discretion. Notification regarding any such change will be announced on-air and/or posted on the Website. 

How to Vote Online: Log onto the Website and view the Voting choices available during the Weekly Voting Period. You may submit your Vote by clicking on your selection. A voting confirmation page will appear confirming your selection.

How to Vote by Text Message: If you have a text messaging capable cell phone from a participating carrier, you may text an eligible Top Chef contestant’s first or last name corresponding to your Vote to the short code announced on-air, which may also be posted on the Website and is currently expected to be 27286. Eligible contestants will be announced in on-air promotional spots and/or on the Website during each in the Weekly Voting Period. Standard text messaging rates apply to all text messages sent and received in connection with the Voting. Please use caution and do not drive while text messaging.

General Conditions: Bravo has the right, in its sole discretion, to void any Vote that appears to have been made by a person not meeting the eligibility requirements set forth above, or to be an automated or duplicate Vote, and has the right to permanently disqualify from any Voting any person it believes has violated these Rules and Procedures. If for any reason the Voting is not capable of being run or implemented as planned, including, but not limited to, as the result of infection by computer viruses or bugs, tampering, unauthorized intervention, fraud, or any other cause beyond the control of Bravo, which is likely to, or actually corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Voting, then Bravo reserves the right, in its sole discretion, to withdraw the transmission of any Vote and/or to terminate or suspend the Voting at any point and declare the Voting results based upon the Votes up to that point. In the event of technical difficulties with the Voting, including, but not limited to, mobile or Internet service interruptions, Bravo reserves the right to review the Votes for accuracy and to take any appropriate action, including, without limitation, voiding the Votes cast during the time period in which such technical difficulties occurred. Bravo, NBCUniversal Media, LLC, their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, any other entity involved in the development or administration of the Voting, and each of their respective directors, officers, employees and assigns (collectively the “Released Parties”) are not responsible for any computer, network, technical, electronic, human or other errors or problems of any kind, for any injury or damage to participants or to any person’s computer or mobile phone relating to or resulting from Voting or downloading materials or software in connection with the Voting, or for Votes that are stolen, misdirected, garbled, delayed, lost, or late. By participating, each individual agrees to release and hold the Released Parties harmless against any and all claims and liability of any kind arising in whole or in part, directly or indirectly, out of their participation in the Voting. Administrators will take reasonable steps where practicable to prevent Voting outside of the Geographic Area; however, some Votes cast outside of the Geographic Area may be counted, and such individual waives any claims such individual may have against the Administrators as a result of the inclusion of such Votes.

Caution: Any attempt by you or any other individual to deliberately damage any online service, mobile phone service, or website, tamper with the Voting process, or otherwise undermine the legitimate operation of the Voting is a violation of criminal and civil laws and should such an attempt be made, the Released Parties reserve the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law.

Disputes: THESE RULES, AND THE SUBMISSION OF YOUR VOTE, ARE GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.

SMS Voting Terms

Top Chef Fan Favorite voting via SMS from your mobile device - votes will only be accepted under the following regulations:

1. To participate, text the promoted keyword (contestant first name) to the short code: e.g., “Text NIGEL to 27286”.

2. Your carrier's standard message and data rates may apply.

3. To opt-out of the Top Chef Fan Favorite SMS voting program at any time, send STOP, QUIT, CANCEL, END or UNSUBSCRIBE to 27286. If you interact with the Top Chef Fan Favorite voting program after sending a STOP or other opt out keyword, you will receive the appropriate response message(s). For example, if you vote again after having opted out, you may receive a vote confirmation message.

4. To get help with voting by SMS, send HELP to 27286, or e-mail Telescope customer service at info@telescope.tv.

5. During a valid vote window, users will receive 1 ‘Thanks for Voting' message per contestant voted for, per vote episode, regardless of the number of votes cast.

6. Only the first 40 votes per mobile phone number per voting episode that are cast from a user within a valid vote window will be counted, but message and data rates may apply to all SMS votes cast (even those in excess of 40).

Requirements/Instructions

Subscribers must:

• Use a wireless device capable of two-way messaging

• Provide their own wireless device

• Be a wireless service subscriber with a participating carrier with a telephone area code from within the 50 US States and District of Columbia

• Participating carriers are:

• AT&T, Verizon Wireless, Sprint, T-Mobile, Boost, Alltel, U.S. Cellular, Nextel Wireless, Virgin Mobile, Dobson, Cincinnati Bell, Cellular South, NTELOS, CellCom, Carolina West, Bluegrass Cellular, Cellular One, Centennial Communications, EKN, GCI Comms, Illinois Valley Cellular, Immix, Inland Cellular, Nex-Tech, Revol, United Wireless, West Central Wireless. The carriers are not liable for any delayed or undelivered messages.

Data Rates/Charges

Message and data rates may apply. A wireless service provider may charge for each text message that is sent and received. Message and data charges will appear on the customer's cell phone bill or be deducted from their prepaid account. Messages sent and received include:

• SMS/text votes sent;
• THANKS FOR VOTING message received;

• EXCEEDED LIMIT message received;
• STOP message sent and STOP confirmation received;
• HELP message sent and HELP information received;
• VOTING CLOSED message received; and
• UNRECOGNIZABLE message received.

SMS Services
The service is offered on an ‘as is' basis and
• May not be available in all areas at all times;
• May not continue to work in the event of product, software, coverage or other service changes made by your wireless carrier;
• Administrator(s) are not responsible for damages from use of service;

• At any time by giving prior notice charges can be incurred and disagreeing to charges would discontinue the service.

Privacy

All information collected in connection with the Top Chef Fan Favorite voting service is governed by the Privacy Policy located at https://www.nbcuniversal.com/privacy . By voting via the text voting method, you are granting NBCU, Bravo TV (collectively, “Producers”) and their vendors the right to collect and use your cell phone number to validate the vote and for other permissible purposes set forth in the governing Privacy Policy located at https://www.nbcuniversal.com/privacy .

Limitation of Liability/Release

Bravo, Producers and/or Telescope, Inc., and the administrators of Top Chef Fan Favorite, their respective parents, subsidiaries and affiliated entities and any persons employed by any of the foregoing, are not responsible and shall not be liable for any losses/injuries or any kind resulting from lost, incomplete, late, damaged or misdirected votes; inability to access the voting; difficulties, failures or malfunctions of computers and/or Internet connections or wireless services or other communications malfunctions; interrupted or unavailable network, server; failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion or for any technical problem which may cause the voting to be disrupted or corrupted; computer on-line systems, telecast, or cable malfunctions; human error; satellite transmission failures or delayed telecasts or preemption of or the failure of a cable affiliate to televise the promotion; any damage to entrants or any third person’s computer and/or wireless device, and/or its contents related to or resulting from this promotion; any votes that are not in compliance with these Terms and Conditions (such votes to be deemed disqualified), nor any other loss directly or indirectly caused by participation in this promotion or related voting.

Bravo, Producers and/or Telescope reserve the absolute right to disqualify any voter (and/or their respective vote(s)) who votes by any electronic, mechanical or automated means, or otherwise tampers with the voting process or promotion, or for any other reason, as determined by Bravo, Producers and/or Telescope in their sole discretion.

Choice of Law/Arbitration

This Agreement shall be construed in accordance with the laws of the State of California applicable to contracts made and fully to be performed therein.

PLEASE NOTE THAT THE “ARBITRATION AGREEMENT” SECTION OF THE TERMS OF USE CONTAINS PROVISIONS THAT REQUIRE (i) WITH LIMITED EXCEPTIONS, ALL DISPUTES ARISING BETWEEN YOU AND PRODUCERS UNDER THIS AGREEMENT BE HANDLED BY ARBITRATION, AND (ii) YOU AND PRODUCERS WAIVE THE RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION IN CONNECTION WITH SUCH DISPUTES.
