TMZ has obtained a police affidavit about the incident, which occurred on Sunday, February 23 during what was supposed to be a custody exchange that morning between Jules and her estranged husband, Michael Wainstein, amid their ongoing divorce. Michael was dropping their kids, Jagger and Rio, off with Jules.

Police say Michael told them he started recording Jules on his phone because he felt threatened by her after a previous argument over the phone about child support payments. Michael told police that when Jules got out of her car, she pulled a baseball bat from her backseat but immediately placed it on the floor, according to the police affidavit obtained by TMZ.

Police say when they talked to Jules, she admitted to pulling the bat and putting it down on the ground before approaching him, telling them, "I was angry" and "I smacked him."

Michael told police that Jules punched and scratched him in the face, according to the police affidavit. Police also said they noticed a reddish mark on his left cheek and a small scratch on his nose.

Jules was arrested on February 23 in Boca Raton, Florida for domestic battery. She spent the night in jail in Palm Beach County's main detention center and was released on Monday under her own recognizance.

Jules appeared in court on Monday, February 24, as did Michael, according to Page Six. She is scheduled to appear in court on Tuesday, February 25, TMZ reports. Her arraignment is scheduled for March 16.

Michael's attorney, Morghan Richardson, told Page Six that Michael is “exploring all of his legal options at this time.”

“This is a serious situation reflecting Ms. Wainstein’s increasingly reckless behavior that unfortunately took place in front of the kids,” Richardson said. “The children were released to Michael’s custody yesterday and he is most concerned about protecting them.”

Michael has obtained a protective order against Jules, according to Page Six.

Jules did not immediately return The Daily Dish's request for comment. Her attorney didn't immediately return Page Six's request for comment.

Jules previously opened up about going through a divorce in the public eye during an interview with BravoTV.com's Life After Bravo video series on July 18, 2019, which you can view, above.

"Until my divorce is over, I'm temporarily living in Boca [in Florida] at my parents, which actually happened to be a nice thing because unfortunately my father just recently passed away," she shared. "So we got to spend the last year with him, which we wouldn't have spent as much time if we were living in New York. So we'll be there until things settle, and then hopefully we'll move back soon."
